In this sense, it is important to highlight that the business activity must be carried out with the support of preventive law, which can avoid problems, avoid some "headaches" that would be avoidable, if the warnings and warnings specific to legal advice are followed. But there, the “advice” is no longer merely gratuitous, not least because it involves more than just “advice”, and more consultancy provided in a professional manner, that is, we are already within the scope of the typical activity of law.
In fact, the specific name does not matter - whether legal advice, consultancy or preventive advocacy - as the main objective is to try to prevent problems from arising (predictable and, therefore, avoidable), with the complicator of the possible filing of lawsuits, with all the drawbacks that we all know about.
It is easy to see that business activity flows more naturally when time, energy and resources are not wasted on disputes that can be avoided. However, it is not uncommon to find businessmen with a warlike mindset, focused on strife, with difficulty in establishing agreements, which is usually very harmful to the activity itself.
The company that seeks to reduce the possibility (or the quantity) of lawsuits against you, has more time to negotiate better, builds a more solid and respectable image and establishes healthier and safer relationships with its customers and even with its suppliers. And, above all, it still has greater profit.
But, after all, what is preventive advocacy?
It is precisely the advice given by a legal professional, in relation to the various areas, in which the business activity is involved, with the objective of promoting an act in advance, with the adoption of a proactive stance in dealing with legal issues, in order to prevent and avoid the realization of problems, which can lead to high costs for their solution.
In this context, preventive advocacy has proven to be a great ally for entrepreneurs, a real investment that will bring significant benefits, not only in the strictly financial field, but also in terms of saving time, which can be used to increase their sales and other activities specific to your business, which is precisely the time that will not be subtracted from unsuccessful demands, due to sensible and prior professional guidance.
The idea is exactly this: the advice prior to decision-making, the intervention of the lawyer long before the possibility of the existence of a judicial or extrajudicial demand, removing or minimizing expenses, emotional stress and natural wear and tear that every dispute usually brings. Here it is worth remembering another popular saying: “a bad deal is better than a good demand”.
It must not be forgotten that business activity is surrounded by several legal implications, such as tax, labor, tax obligations, relations with suppliers and consumers, the signing of contracts and terminations, among many other peculiarities, and this all indicates the the need for the entrepreneur to be efficiently advised, so that he can dedicate himself with tranquility to what constitutes the essence of his business.
With preventive advocacy, the cost-benefit ratio is much more profitable, in economic terms, even when compared to the costs (and false benefits) resulting from a lawsuit, for example, in which expenses with costs are added procedural, succumbence, expertise, attorney's fees, fines, possible pledges of assets, blocking of bank accounts.
As can be seen, neither situation is compared with another. The disparity is very significant.
Hence it is concluded, it can be said that preventive work is strategic, both in the business field itself, as in the legal area, and this is for any enterprise (from small to large entrepreneur), because for those who conduct their business in a planned way and, well assisted, there is time to execute their projects, to implement their ideas, to expand their businesses, which puts them ahead of the competition.
Especially in times of crisis, such as the one currently experiencing in the world, the unjustifiable loss of the entrepreneur's precious time with unimportant issues, or with easy-to-solve problems, is not reasonable. One should seek to simplify what is possible, in order to focus all attention on what really deserves to be prioritized, that is, on the typical product or service of the company, on the marketing strategy, etc.
Anyway, nothing better than having full conditions to carry out your activities with more tranquility, accuracy and common sense, which, unfortunately, is not always seen in times of “skinny cows”, when anguish, fear of future and anxiety.
